Terms of Use
These Terms of Use (“Terms”) apply to your use of Tally It Up (the “App”), published by Arvanta Holdings Inc. By using the App, you agree to these Terms. If you don’t agree, please don’t use the App.
License to use the App
Arvanta Holdings Inc. grants you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial scorekeeping. You may not copy, modify, distribute, sell, or reverse-engineer the App except as permitted by law.
Acceptable use
Use the App lawfully and reasonably. Don’t attempt to disrupt or misuse it, interfere with its intended operation, or use it to infringe anyone’s rights.
Your content
The names, scores, rules, and other information you enter are yours. They are stored on your device (see the Privacy Policy). You are responsible for the content you enter and for keeping your own backups if you want them.
Intellectual property
The App — including its software, design, look and feel, branding, logos, and content provided by Arvanta Holdings Inc. — is owned by or licensed to Arvanta Holdings Inc. and is protected by intellectual property laws. These Terms don’t transfer any ownership to you.
Disclaimers
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don’t warrant that the App will be uninterrupted, error-free, or that scores and calculations will be free of mistakes. Please double-check anything that matters.
Limitation of liability
To the fullest extent permitted by law, Arvanta Holdings Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App.
Changes to the App and these Terms
We may update, change, or discontinue features of the App, and we may update these Terms. If we make material changes to these Terms, we’ll update the “effective” date above. Continuing to use the App after changes means you accept the updated Terms.
Termination
You may stop using the App at any time by deleting it. We may suspend or end access to the App or its features where reasonably necessary, for example to comply with law or protect the App.
Apple App Store
If you downloaded the App from the Apple App Store, your use is also subject to Apple’s standard Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where those terms apply, Apple is not responsible for the App or its support, and Apple is a third-party beneficiary of these Terms and may enforce them.
Governing law
These Terms are governed by the laws of the United States and the state in which Arvanta Holdings Inc. is organized, without regard to conflict-of-laws principles. You and Arvanta Holdings Inc. agree to the exclusive jurisdiction of the courts located there for any dispute not subject to the Apple App Store terms above.
